Det som är olagligt (tekniskt sett en gråzon då det finns konflikterande punkter i lagen och det har aldrig beprövats) är processen då emulatorn dekrypterar spelen, det är alltså precis lika "olagligt" oavsett om nyckeln är inkluderad eller ej, detta vet nintendos advokater mycket väl och poängteras både i deras brev till valve samt i deras stämningsansökan mot yuzu.
Vet inte var du får det citatet ifrån men det stämmer inte över huvud taget, rekomenderar att du tar och läser dolphins artikel om vad som hände och även brevet från nintendos law firm, ingenstans säger de att de hade agerat utan snarare pekar brevet på att de inte hade någon aning om att dolphin skulle släppas alls.
Nintendo har inte heller gjort någonting för att stoppa dolphin i övrigt, emulatorn är inte mindre "olaglig" i deras ögon för att den finns på en annan hemsida och github, DMCA strikes går att använda där med.
Vad har gett dig den villfarelsen? Att Nintendo inte brytt sig om att anmälda Dolphin på andra platser är för att de inte måste anmäla alla fall (de kan inte förlora något ala Trademark) så det står dem helt fritt att anmäla eller inte anmäla var och hur de vill.

descramble a scrambled work, to decrypt an encrypted work,

a work’ if the measure, in the ordinary course of its operation,
requires the application of information, or a process or a treat-

Det enda som jag kan tänka mig att du tänker på är att slutanvändare i vissa fall blivit friade av domstolar i USA, men vi pratar inte om slutanvändare här utan om de som tillverkar och distribuerar mjukvara som kringgår skydd.
