Apple Corps styrs av de tidigare Beatles-medlemmarna Sir Paul McCartney, Ringo Starr samt familjerna till George Harrison och John Lennon. De hävdar att Apple Computer brutit de avtal de kom överens om 1991, som gick ut på att det inte skulle bli två äpplen i musikbranschen.
Men domaren ansåg att Apple Computer inte brutit avtalet, eftersom de använder deras logotyp i samband med affären, men inte i samband med själva musiken. Dessutom tillade han att det är en form av elektronisk affär, och att de inte tillverkar musik:
I think that the use of the apple logo is a fair and reasonable use of the mark in connection with the service, which does not go further and unfairly or unreasonably suggest an additional association with the creative works themselves
Apple Computer blev givetvis glada över domslutet, så här uttalade sig Apples VD Steve Jobs:
We are glad to put this disagreement behind us. We have always loved The Beatles, and hopefully we can now work together to get them on the iTunes Music Store
Apple har hittils sålt över en miljard låtar via Itunes Music Store, men The Beatles saknas i princip helt i utbudet. Detta är tredje gången parterna gör upp i domstol, om det är nu definitivt slut på äpplernas krig återstår dock att se. Apple Corps tänker nämligen överklaga.
